User Agreement

1. Acceptance of Terms

By downloading, installing, accessing, or using the "Youmi" mobile application (the "App"), provided by Youmi Team ("we," "us," or "our"), you agree to be bound by this User Agreement ("Agreement"). If you do not agree to these terms, please do not use the App.

2. Eligibility

You must be at least 17 years old to use this App. By using the App, you represent and warrant that you meet this age requirement and have the legal capacity to enter into this Agreement.

3. Description of Service

Youmi is an AI-powered image-to-image travel art application. It allows users to upload travel photos, choose artistic styles, and generate postcard-style images or vintage travel posters using artificial intelligence technology.

4. User Accounts

• Registration: You may need to register an account using your Name, Username, and Email.
• Security: You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account.
• Accuracy: You agree to provide accurate and current information during registration.

5. User Content and Conduct

5.1 Your Content

You retain all ownership rights to the photos you upload ("User Content"). By uploading User Content, you grant Youmi Team a non-exclusive, worldwide, royalty-free, and transferable license to use, reproduce, modify, adapt, and process your User Content solely for the purpose of operating the App and generating the requested artwork for you.

5.2 AI Generations

You understand that the images generated by the App ("Generations") are created by Artificial Intelligence. You own the Generations created from your User Content, subject to the underlying rights in the original photo.

5.3 Prohibited Conduct

You agree NOT to:

• Upload content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or invasive of another's privacy.
• Upload content that infringes on any patent, trademark, trade secret, copyright, or other proprietary rights of any party.
• Use the App for any illegal or unauthorized purpose.
• Reverse engineer, decompile, or disassemble the App.
• Use automated scripts to collect information from or otherwise interact with the App.
• Harass or harm another person or entity.

6. Intellectual Property

The App, including its software, code, design, graphics, and logos (excluding User Content), is the property of Youmi Team and is protected by copyright and other intellectual property laws.

7. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into this Agreement by reference.

8. Disclaimer of Warranties

The App is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, expressed or implied, regarding the App's operation, the accuracy of AI generations, or that the App will be error-free or uninterrupted. The AI-generated content may vary and we do not guarantee specific artistic results.

9. Limitation of Liability

To the fullest extent permitted by law, Youmi Team shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or use, arising out of or in connection with your use of the App.

10. Indemnification

You agree to indemnify and hold harmless Youmi Team from any claims, damages, liabilities, and expenses arising out of your use of the App or your violation of this Agreement.

11. Termination

We reserve the right to suspend or terminate your access to the App at our sole discretion, without notice, for conduct that we believe violates this Agreement or is harmful to other users, us, or third parties.

12. Governing Law and Dispute Resolution

• Governing Law: This Agreement shall be governed by the laws of our principal place of business, without regard to its conflict of law provisions.
• Binding Arbitration: Any dispute arising from or relating to this Agreement shall be resolved through binding arbitration, rather than in court.

13. Changes to Terms

We reserve the right to modify this Agreement at any time. We will provide notice of significant changes. Your continued use of the App after such changes constitutes your acceptance of the new terms.
